Thanks for entrusting Leaf Stack Studio Inc. (“Spck Editor”, “we”) with your source code, your projects, and your personal information. Holding on to your private information is a serious responsibility, and we want you to know how we’re handling it.

All capitalized terms have their definition in Spck Editor’s Terms of Service, unless otherwise noted here.

We reserve the right to change our practices and this Privacy Policy at any time. Each time a user accesses our Services or our Sites, the then current version of the Privacy Policy applies, and you agree that the information we collect will be subject to the Privacy Policy, as updated. We encourage you to check this page regularly so that you know our current practices.

Please note that this Privacy Policy only applies to the Services. We process Personal Information (defined below) lawfully pursuant to one of three bases: where we have your consent (such as where you opt-in to marketing communications), where we have a legitimate interest in doing so (such as providing you with customer support), where necessary for performing a contract with you (such as our Terms of Service, to which you agree as a condition of using the Services), or where we have a legal obligation (such as where a court order compels us). What information we collect

“User Personal Information” is any information about one of our Users which could, alone or together with other information, personally identify them or otherwise be reasonably linked or connected with them. Information such as a username and password, an email address, a real name, an Internet protocol (IP) address, and a photograph are examples of “User Personal Information.”

User Personal Information does not include aggregated, non-personally identifying information that does not identify a User or cannot otherwise be reasonably linked or connected with them. We may use such aggregated, non-personally identifying information for research purposes and to operate, analyze, improve, and optimize our Website and Service.

Registration information

We require some basic information at the time of account creation. When you create your account, we will request access from third party authentication service providers to information such as a real name, an email address, or an unique ID to identify your account.

Information automatically collected from your use of the Service

Payment information

When placing orders, our e-commerce provider handles your personal information and keeps it safe and secure. We cannot access your credit card information. Your personal information (excluding credit card data) is shared with us only for administration purposes.

Usage information

If you’re accessing our Service or Website, we automatically collect the same basic information that most services collect, subject, where necessary, to your consent. This includes information about how you use the Service, such as the pages you view, the referring site, your IP address and session information, and the date and time of each request. This is information we collect from every visitor to our Site, whether they have an Account or not. This information may include User Personal information.

Device information

We may collect certain information about your device, such as its IP address, browser or client application information, language preference, operating system and application version, screen size, a randomly generated strings for identifying a session. This information may include User Personal information.

Anonymous usage information

We may collect information regarding the usage of particular features or errors logs that occur when using the Service or App. No personal information is collected in such cases; a hash of a randomly generated ID which will be used to identify a browsing session which can be cleared by uninstalling the App or wiping its cache.

Information we collect from third parties

Spck Editor may collect User Personal Information from third parties. For example, this may happen if you sign up with one of our vendors, partners, or affiliates. We do not purchase User Personal Information from third-party data brokers.

What information we do not collect

We do not intentionally collect “Sensitive Personal Information”, such as personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. If you choose to store any Sensitive Personal Information on our servers, you are responsible for complying with any regulatory controls regarding that data.

Information from children

Minors and children should not use our Site and Services without consent and supervision of an adult. By using the Website, you represent that you have the legal capacity to enter into a binding agreement. Our Site and Service are not directed to children under the age of 13 (or 16 years of age if residing in the EU/EEA) and we do not knowingly collect Personal Information from children under the age of 13 (or 16 in EU/EEA). If we learn that we have collected Personal Information of a child under the age 13 (or 16 in EU/EEA), we will take reasonable steps to delete such information from our files as soon as is practicable. With your consent

We share your User Personal Information, if you consent, after letting you know what information will be shared, with whom, and why. For example, if you purchase an application listed on our Marketplace, we share your username to allow the application Developer to provide you with services. Additionally, you may direct us through your actions on Spck Editor to share your User Personal Information. For example, if you join an Organization, you indicate your willingness to provide the owner of the Organization with the ability to view your activity in the Organization’s access log.

For security purposes

If you are a member of an Organization, Spck Editor may share your username, Usage Information, and Device Information associated with that Organization with an owner and/or administrator of the Organization, to the extent that such information is provided only to investigate or respond to a security incident that affects or compromises the security of that particular Organization.

For legal disclosure

Spck Editor strives for transparency in complying with legal process and legal obligations. Unless prevented from doing so by law or court order, or in rare, exigent circumstances, we make a reasonable effort to notify users of any legally compelled or required disclosure of their information. We may disclose User Personal Information or other information we collect about you to law enforcement if required in response to a valid subpoena, court order, search warrant, a similar government order, or when we believe in good faith that disclosure is necessary to comply with our legal obligations, to protect our property or rights, or those of third parties or the public at large.

Change in control or sale

We may share User Personal Information if we are involved in a merger, sale, or acquisition of corporate entities or business units. If any such change of ownership happens, we will ensure that it is under terms that preserve the confidentiality of User Personal Information, and we will notify you on our Website or by email before any transfer of your User Personal Information. The organization receiving any User Personal Information will have to honor any promises we made in our Privacy Statement or Terms of Service.

Aggregate, non-personally identifying information

We share certain aggregated, non-personally identifying information with others about how our users, collectively, use Spck Editor.

We do not sell your User Personal Information for monetary or other consideration.

California Requirements

Exercising your rights: If you are a California resident, there are some additional rights that may be available to you under the California Consumer Protection Act (“CCPA”). This policy explains the tools that we have made available to you to exercise your data rights under the CCPA, such as the right to deletion and the right to request access to the categories of information we have collected about you. You will not be discriminated against for exercising any of your privacy rights under the CCPA. In order to protect your information from unauthorized access or deletion, we may require you to provide additional information for verification. If we cannot verify your identity, we will not provide or delete your information.

Sharing your personal information: We don’t sell your personal information. We do share your information with others as described in the “How we share the information we collect” section of this policy.

Processing your information: This policy describes how we collect and use your personal information, and our deletion and retention policies. We’ve also included information about how we may process your information, which includes for “business purposes” under the CCPA - such as to protect against illegal activities, and for the development of new products, features, and technologies. How we store and secure information we collect

Spck Editor takes all measures reasonably necessary to protect User Personal Information from unauthorized access, alteration, or destruction; maintain data accuracy; and help ensure the appropriate use of User Personal Information.

Transmission of data from our Services is encrypted using SSH, HTTPS (TLS). While we implement safeguards designed to protect your information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that information, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others.

We and our service providers may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. For example, we transfer personal data to Amazon Web Services, one of our service providers that processes personal information for us in various data center locations across the globe, including those listed here. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.

How to access and control the information we collect

If you’re already a Spck Editor user, you may access, alter, or delete your basic user profile information by through your Account settings or by contacting [email protected]. You can control the information we collect about you changing the consent options in your Account settings such as Email Consent, or by contacting [email protected].

If we process information about you, such as information Spck Editor receives from third parties, and you do not have an account, then you may, subject to applicable law, access, update, alter, delete, or object to the processing of your personal information by contacting [email protected].

Data portability

As a Spck Editor User, you can always take your data with you. You can use the “Download Account Info” feature in your Account settings to download information we have about you.

Data retention and deletion of data

Generally, we retain User Personal Information for as long as your account is active or as needed to provide you services. We retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements, but barring legal requirements, we will delete your full profile (within reason) within 90 days of your request. You may contact [email protected] to request the erasure of the data we process on the basis of consent within 30 days.

Our use of cookies and tracking

Cookies

Spck Editor uses cookies and similar web browser technologies, like local storage and IndexedDB for storing settings as well as to provide you with our Services.

Cookies are small text files that websites often store on computer hard drives or mobile devices of visitors. We use cookies to provide you our services, for example, to keep you logged in, remember your preferences, identify your device for security purposes, and provide information for future development of Spck Editor. By using our Website, you agree that we can place these types of cookies on your computer or device. If you disable your browser or device’s ability to accept these cookies, you will not be able to log in or use our Services.

Another browser technology we use to store content, code, graphics, fonts, text, or other information is called IndexedDB. This provides long term persistent storage of such data on your computer.

You can adjust your browser settings to block cookies or access to local storage. Some features of the Site will not work if cookies are blocked.

Cloudflare

Cloudflare is a traffic optimization and distribution service provided by Cloudflare Inc. The way Cloudflare is integrated means that it filters all the traffic through our Site, i.e., communication between our Site and the User’s browser, while also allowing analytical data from this Application to be collected.

This type of service allows this Application to distribute their content using servers located across different countries and to optimize their performance. Considering the widespread distribution of this system, it is difficult to determine the locations to which the contents that may contain Personal Information User are transferred.

How we communicate with you

We use your email address to communicate with you, if you’ve said that’s okay, and only for the reasons you’ve said that’s okay. For example, if you contact our Support team with a request, we respond to you via email. You have a lot of control over how your email address is used and shared on and through Spck Editor.

We may contact you, by email or other means about product, new features, subscription offers, and community activity or events. You can opt out of all email notifications by clicking the unsubscribe link in any marketing email you receive from us.

By design, the Git version control system associates many actions with a User’s email address, such as commit messages. We are not able to change many aspects of the Git system. If you would like your email address to remain private, please do not enter your email in your Git credentials settings.

Depending on your email settings, we may occasionally send important communications to your email, such as emails from our Support team or system emails. You can remove your email address from being stored on our servers by removing “Email Consent” in your account settings. If your email is not stored on our server, you will not receive important communications from us unless you have opt-in to this communication by sending us an email.

Changes to our Privacy Policy

Although most changes are likely to be minor, we may change our Privacy Policy from time to time. We will provide notification to Users of material changes to this Privacy Policy through our Website at least 30 days prior to the change taking effect by posting a notice on our home page, login screens, or by sending you an email notification. We will also keep prior versions of this Privacy Policy in an archive for your review. We encourage you to review our privacy policy whenever you use the Services to stay informed about our information practices and the ways you can help protect your privacy.
